Pool employee charged with exposing victim to HIV

MEMPHIS, TN (WMC-TV) - An employee at the Westwood Community Center has been charged with aggravated assault and exposing his victim to HIV.

Investigators said Timothy Bernard Payne, 37, an employee at Westwood's swimming pool, offered to give a 17-year-old girl a ride home on July 31.  Instead of taking her home, officials said, Payne drove to his house on East Trigg Avenue, before driving to the end of West Shelby Drive, near a set of train tracks. 

According to the affidavit of complaint, Payne pulled a knife from the girl's backpack, forced her to take off her clothes, and raped her at knife point.

Payne, who is HIV positive, was charged with aggravated rape and criminal exposure to HIV.

"They have to know that, and they do not take precautions or do not inform the person of what their HIV status is," said Memphis Police Major Joe Scott.

Scott said investigators with the Memphis Police Department's Sex Crimes Bureau believe Bernard has allegedly had consensual sex with several underage females in the Westwood and south Memphis area.

"We have information there may be other victims and these victims may be consensual," he said. "It may not be that a rape has taken place, but these victims may be consensual, and they may be underage."

Scott said investigators want to speak with anyone who has had sexual contact with Payne, and asked any potential victims to call the Sex Crimes Bureau at 901-545-5330.

Payne is being held at the Shelby County Jail on a $250,000 bond.
