Appeals Court to hear fondling case

JACKSON, Miss. (AP) - A Hernando truck driver has appealed a 10-year sentence handed down in 2006 for his conviction of fondling a 7-year-old girl.

Jimmy Dale Mayhan also was placed on five years post-release supervision by DeSoto County Circuit Judge Bobby Chamberlin.

Mayhan's post conviction petition appeal is among dozens of cases the state Court of Appeals will consider during the January-February term.

Mayhan had been scheduled for trial in April 2006 on charges of fondling four children between June 1, 2004, and July 30, 2005. He chose instead to accept a plea offer from the district attorney's office. Mayhan pleaded no contest to one count.

Chamberlin rejected a defense motion to withdraw the plea and set a trial date for Mayhan.
