Memphis-based Pinnacle Airlines named in Flight 3407 lawsuit

Memphis-based Pinnacle Airlines has been named in a lawsuit filed by family members of a victim who perished in a recent plane crash near Buffalo, New York.

The lawsuit claims the aircraft had inadequate deicing equipment and an improperly-trained crew.

The lawsuit is the first to be filed since Continental Connection Flight 3407 crashed on February 12. 50 people were killed, including one person on the ground.

As the investigation continues, family members of one victim are seeking an unspecified amount in damages from the flight's operator, Continental Airlines, Memphis-based Pinnacle Airlines and Colgan Air, a Pinnacle subsidiary.

The lawsuit states: "For a measurable period of time, the aircraft flew out of control, violently moved in unexpected directions, dived, rolled, inverted and subjected the passengers and contents to unusual g-forces."

The National Transportation Safety Board is looking into the claims listed in the lawsuit.
 
"Even the inexperienced aviator who hasn't flown very much is still trained by their airline, and trained well." said Capt. Steve Chealander, and NTSB Board Member.

Pinnacle airlines declined to comment Friday. But in the days following the crash, Pinnacle Airlines Spokeperson Amy Howell expressed her sympathy for the victims.
 
"You hope you never have to deal with it. It's a very sad day for Pinnacle and Colgan," she said.

The NTSB investigation is expected to take a year or more.

More lawsuits are expected to be filed on behalf of those who lost a loved one.
